    Purpose & Overall Relevance for the Organization:

    The Legal Counsel for Litigation in India is responsible for overseeing and managing all legal matters including but not limited to litigation for and on behalf of the organization. This role involves providing strategic legal advice, representing the company in legal proceedings, and ensuring compliance with applicable laws and regulations. The Legal Counsel for Litigation will work closely with internal stakeholders, external legal counsel, and regulatory authorities to protect the Company's interests and resolve disputes.

    Key responsibilities:

    Litigation Strategy:

      • Develop and implement effective litigation strategies in alignment with the organization's goals and objectives.
      • Provide legal advice to internal departments on potential litigation risks and preventive measures.

    Representation:

      • Represent the company in various courts, tribunals, and alternative dispute resolution forums.
      • Prepare and file legal documents, pleadings, and motions as required.

    Case Management:

      • Manage and oversee all aspects of litigation cases, including conducting legal research, drafting legal documents, and preparing for hearings.
      • Collaborate with external legal counsel to ensure effective representation and adherence to legal standards.

    Compliance:

      • Stay updated on changes in laws and regulations that may impact litigation matters.
      • Ensure the organization's compliance with legal requirements and minimize legal risks.

    Settlement Negotiations:

      • Negotiate settlements and alternative dispute resolutions to resolve legal matters efficiently and cost-effectively.
      • Assess the merits of potential settlements and advise on the best course of action.

    Document Management:

      • Maintain accurate and up-to-date records of all litigation-related documents and correspondence.
      • Coordinate document discovery processes as necessary.

    Communication:

      • Communicate effectively with internal stakeholders, external legal partners, and regulatory authorities.
      • Provide regular updates on the status of litigation matters to senior management.

    Budget Management:

      • Monitor and manage budgets related to litigation costs and legal expenses.
      • Work to optimize legal costs while maintaining high-quality legal representation.

    Contracts and Advisory Responsibilities:

      • Drafting and reviewing agreements, contracts, and MOUs to ensure legal accuracy and compliance.
      • Providing day-to-day advice to user departments and offering legal assistance for special projects to mitigate the company's liability and safeguard its interests.
      • Representing the company in Courts/Tribunals for matters related to Company Law.
      • Assessing local cyber security and IT laws, supporting the global team in implementation, inquiry, and reporting requirements.
      • Managing and advising on BIS regulations, guiding stakeholders on QCO guidelines on footwear and other related products.
      • Advising on environmental law, advertisement guidelines, trade licenses etc.

    Compliance & Risk Responsibilities:

      • Aligning with the Risk Assessment process and implementing actions to minimize the company's liability and protect its interests.
      • Handling regulatory investigations related to Enforcement Directorate etc.

    Requisite Education and Experience / Minimum Qualifications:

    • Bachelor's degree in Law (LLB) from a recognized Law School/University; additional specialization in litigation preferred.
    • Minimum [6-10] years of relevant experience in litigation, preferably with experience in a corporate legal department of a multinational corporation or a law firm.
    • Admission to the Bar Council of India.
    • Experience in FMCG, sports company or retail industry is preferred
    • Solid experience in general corporate work, commercial contracts, employment and competition and consumer law.
    • Good knowledge of the legal system in India and the main laws, judicial system and experience in dealing with litigation cases in arbitration and courts
    • Must be willing to participate in a team oriented, consensus-building environment
    • Must be independent, self-motivated and responsive.

    Skills:

    • Strong knowledge of Indian laws and litigation procedures with excellent legal research
    • Strong understanding of corporate and commercial law.
    • Experience in employment and competition and consumer protection law is preferred
    • Excellent written and verbal communication skills are required
    • Strong commercial sense and ability to make practical evaluations of risks and offer pragmatic solutions while managing risk is required
    • Must be fluent in English (written and spoken)
    • High degree of stakeholder orientation and appropriate prioritization
    • Ability to work independently and manage and prioritize substantial and diverse workload in a challenging legal environment
    • Sound judgment and decision-making capabilities.
