The Karur Vysya Bank 

Legal Advisory and Risk Mitigation: Offer legal advice and services to ensure the operation of the bank is in compliance with its charter, rules, statutes, laws, and regulations. Provide sound legal advice to the bank and its legal team on a diverse range of matters, including corporate issues, business models, mergers & acquisitions, lending activities, resource raising, employment issues, etc., with the aim of minimizing legal risks. Leadership and Legal Opinion Formulation: Lead the legal team in formulating binding legal opinions related to national legislation, national law, or relevant matters requiring in-depth legal studies. Such opinions are to be binding on other functional units of the bank. Regulatory Guidance and Litigation Management: Provide direction to the bank and the legal team in response to changing regulatory policy frameworks and business requirements. Assist in all facets of litigations, including predisputes, and supervise in-house legal work where possible. Safeguard the interests of the bank in legal proceedings before various courts, tribunals, arbitrators, regulators, law enforcement agencies, and statutory bodies. RTI Act and Nodal Officer Responsibilities: Act as the Chief Public Information Officer (CPIO) under the Right to Information (RTI) Act.Serve as a nodal officer for all law enforcement agencies, including CBI, ED, DRI, SFIO, Cyber Crime Cells, EOW, SEBI, etc. Contract Management and Business Support: Assist various verticals in contract management. Develop legal resolution strategies for large critical exposures in coordination with relevant business heads and engage with legal counsels and stakeholders. Portfolio Management and Compliance: Ensure lending and resource raising activities comply with defined statutes and regulations. Proactively resolve potential escalations of legal matters to prevent violations of laws/rules. Maintain up-to-date documentation of manuals and process notes governing business activities to comply with applicable laws, rules, and regulations. Empanelment and Advocacy Oversight: Empanel advocates, solicitors, legal firms, and monitor their performance, conducting annual reviews. Undertake any other assignments as may be assigned by the Bank from time to time. SARFAESI Act & Recovery Action for NPA Accounts: Issue recall notices for all NPA accounts. Issue demand notices under section 13(2) of the SARFAESI Act. Take symbolic possession under section 13(4) of the SARFAESI Act. File petitions before the CJM or DM under section 14 of the SARFAESI Act. Execute CJM orders or take physical possession of property. File recovery suits under section 19(1) of The Recovery of Debts and Bankruptcy Act 1993. Manage recovery litigation under arbitration and SARFAESI laws, providing proactive legal strategy for all sticky accounts. Track all legal cases and ensure no slippages in visiting NPA accounts, working with the collection team for faster recovery. Initiate legal actions against borrowers under SARFAESI for recovery, including filing criminal complaints.
